6.1. Service Requests
When you submit a service request, you agree to provide accurate and complete information about your project requirements. We reserve the right to accept or reject any service request at our sole discretion.
6.2. Project Scope and Changes
The scope of work, timeline, and pricing will be agreed upon before work begins. Any changes to the project scope may result in additional fees and timeline adjustments, which must be approved by both parties in writing.
6.3. Delivery and Acceptance
We will deliver completed work according to the agreed timeline. You will have a reasonable period to review and request revisions. Once accepted or after the revision period expires, the work is considered complete.
7. Intellectual Property Rights
7.1. Our Intellectual Property
All content, features, and functionality of our website and services, including but not limited to text, graphics, logos, icons, images, audio, video, software, code, designs, trademarks, service marks, trade names, and other intellectual property (collectively, the "Content"), are owned by Gamma Network LLC, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
The "Gamma Network" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Gamma Network LLC or its affiliates or licensors. You must not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on our services are the trademarks of their respective owners.
7.2. License to Use Website
We grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use our website and services for your personal, non-commercial use only. This license does not include any right to:
- Modify, copy, reproduce, or create derivative works of the Content
- Use the Content for any commercial purpose or public display
- Attempt to decompile, reverse engineer, or disassemble any software
- Remove any copyright, trademark, or other proprietary notices from the Content
- Transfer the Content to another person or mirror the Content on another server
- Use any data mining, robots, or similar data gathering or extraction methods

This license will terminate automatically if you violate any of these restrictions and may be terminated by us at any time. Upon termination, you must destroy all copies of the Content in your possession.
7.3. Work Product Ownership
Upon full payment for custom development work, you will receive ownership rights to the specific work product created for you (the "Deliverables"), subject to the following:
- Ownership is subject to any third-party licenses, open-source components, or pre-existing intellectual property used in the Deliverables
- We retain all rights to general knowledge, techniques, methodologies, know-how, and skills gained or used during the project
- We retain the right to use any pre-existing code, libraries, frameworks, or tools that we own or have licensed
- You may not resell, sublicense, or redistribute the Deliverables without our prior written consent, unless such right is explicitly granted in a separate written agreement
7.4. User Content and Feedback
If you submit, post, or transmit any content, materials, or information to us (including feedback, suggestions, or ideas), you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any media, now known or hereafter developed, for any purpose.
You represent and warrant that you own or have the necessary rights to grant the license described above and that your content does not infringe upon the rights of any third party.
7.5. Copyright Infringement
If you believe that any content on our services infringes your copyright, please contact us at info@gammanetwork.net with a detailed notice containing: (1) identification of the copyrighted work claimed to have been infringed; (2) identification of the material that is claimed to be infringing; (3) your contact information; (4) a statement that you have a good faith belief that use of the material is not authorized; and (5) a statement that the information in the notification is accurate. We will respond to valid copyright infringement notices in accordance with the Digital Millennium Copyright Act (DMCA).
8. User Conduct and Prohibited Activities
You agree not to:
- Use our services for any illegal or unauthorized purpose
- Violate any laws, regulations, or third-party rights
- Interfere with or disrupt our services or servers
- Attempt to gain unauthorized access to our systems or accounts
- Transmit any viruses, malware, or harmful code

10. Disclaimers and Limitations of Liability
10.1. Service Availability
We strive to provide reliable and uninterrupted service, but we do not guarantee that our services will be available at all times, be error-free, or meet your specific requirements. We may experience downtime due to maintenance, updates, technical failures, or circumstances beyond our reasonable control. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
10.2. "As Is" Basis and No Warranties
OUR SERVICES ARE PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAMMA NETWORK LLC EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Warranties of fitness for a particular purpose
- Warranties of non-infringement
- Warranties of title
- Warranties that the services will be uninterrupted, secure, error-free, or free of viruses or other harmful components
- Warranties regarding the accuracy, reliability, or quality of any information, content, or services provided
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
10.3. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GAMMA NETWORK LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY OF THE FOLLOWING, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenues, data, use, goodwill, or other intangible losses
- Loss or damage to property
- Personal injury or death (to the extent permitted by law)
- Costs of procurement of substitute goods or services
- Business interruption or loss of business opportunity
- Any damages resulting from your use of or inability to use our services
10.4. Maximum Liability Cap
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR OUR SERVICES, WHETHER IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD). This limitation applies regardless of whether the claim is based on contract, tort, strict liability, or any other legal theory.
10.5. Essential Basis of the Bargain
The limitations and exclusions of liability set forth in this section are fundamental elements of the basis of the bargain between you and Gamma Network LLC. We would not be able to provide our services on an economic basis without such limitations. You acknowledge and agree that these limitations are reasonable and that you have considered the implications of such limitations.
11. Indemnification
You agree to indemnify, defend, and hold harmless Gamma Network LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any rights of another party.
12. Termination
12.1. Termination by You
You may terminate your account at any time by contacting us or using the account deletion feature, if available.
12.2. Termination by Us
We may suspend or terminate your account and access to our services immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect our business or other users.
12.3. Effect of Termination
Upon termination, your right to use our services will immediately cease. We may delete your account and data, subject to our legal obligations to retain certain records. All outstanding fees remain due and payable.
13. Dispute Resolution and Arbitration
13.1. Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first contact us at info@gammanetwork.net with a description of your concern. We will attempt to resolve the dispute informally within 60 days of receiving your notice. If we cannot resolve the dispute informally, you agree to resolve it through binding arbitration as described below.
13.2. Binding Arbitration
YOU AND GAMMA NETWORK LLC AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS, OUR SERVICES, OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT, except as otherwise set forth in this section.
The arbitration will be conducted by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules and, if applicable, its Supplementary Procedures for Consumer-Related Disputes (collectively, "AAA Rules"), as modified by these Terms. The AAA Rules are available at www.adr.org or by calling 1-800-778-7879.
The arbitration will be conducted in Bernalillo County, New Mexico, unless you and we agree otherwise. The arbitrator's decision will be final and binding, and judgment on the arbitral award may be entered in any court having jurisdiction thereof.
You understand that by agreeing to arbitration, you are waiving your right to a trial by jury and to participate in a class action lawsuit.
13.3. Class Action Waiver
YOU AND GAMMA NETWORK LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Further, unless both you and Gamma Network LLC agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration section shall be null and void.
13.4. Exceptions to Arbitration
Notwithstanding the foregoing, the following disputes are not subject to arbitration and may be brought in court:
- Claims for injunctive or equitable relief
- Claims related to intellectual property rights (copyrights, trademarks, patents, trade secrets)
- Small claims court actions (claims under $10,000)
- Claims that cannot be arbitrated under applicable law
13.5. Waiver of Jury Trial
YOU HEREBY WAIVE YOUR CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR A JURY. You are instead electing to have all claims and disputes resolved by arbitration, except as otherwise set forth in Section 13.4. In any litigation between you and Gamma Network LLC over whether to vacate or enforce an arbitration award, you and Gamma Network LLC waive all rights to a jury trial, and elect instead to have the dispute be resolved by a judge.
13.6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. The Federal Arbitration Act, 9 U.S.C. § 1 et seq., will govern the interpretation and enforcement of this arbitration provision.
13.7. Jurisdiction for Court Proceedings
For any disputes that are not subject to arbitration as set forth in Section 13.4, or if the arbitration provision is found to be unenforceable, any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Bernalillo County, New Mexico. You consent to the personal jurisdiction of such courts and waive any objection to the laying of venue in such courts.
13.8. Statute of Limitations
You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to these Terms or our services must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the modified Terms.
15. Severability and Reformation
If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, that provision shall be:
- Modified to the minimum extent necessary to make it enforceable, valid, and legal, or
- If modification is not possible, severed from these Terms
The remaining provisions of these Terms shall remain in full force and effect. If any provision is found to be unenforceable, the parties agree that the court should attempt to give effect to the parties' intentions as reflected in the provision, and the remainder of these Terms shall remain in full force and effect.
Notwithstanding the foregoing, if the arbitration provision in Section 13.2 is found to be unenforceable, the class action waiver in Section 13.3 shall also be unenforceable, and disputes shall be resolved in court as set forth in Section 13.7.
16. Force Majeure
Gamma Network LLC shall not be liable for any failure or delay in performance under these Terms which is due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics, network or infrastructure failures, cyber attacks, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. In such event, we will use reasonable efforts to notify you and resume performance as soon as practicable.
17. Waiver and Rights
No waiver by Gamma Network LLC of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure of Gamma Network LLC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Gamma Network LLC.
The rights and remedies provided in these Terms are cumulative and not exclusive of any rights or remedies provided by law. You acknowledge that you have read these Terms, understand them, and agree to be bound by them. You further acknowledge that these Terms, together with our Privacy Policy, Refund Policy, and Cookie Policy, represent the complete and exclusive statement of the agreement between you and Gamma Network LLC.
You waive any rights or claims you may have under any other agreement, understanding, or course of dealing, except as explicitly set forth in these Terms.
18. Survival
The following provisions shall survive termination of these Terms and your use of our services:
- Intellectual Property Rights (Section 7)
- Disclaimers and Limitations of Liability (Section 10)
- Indemnification (Section 11)
- Dispute Resolution and Arbitration (Section 13)
- Governing Law and Jurisdiction (Section 13)
- Entire Agreement (Section 19)
- Any payment obligations or outstanding fees
- Any provisions that by their nature should survive termination
19. Assignment
You may not assign or transfer these Terms, or any rights or obligations hereunder, by operation of law or otherwise, without our prior written consent. Any attempt to assign or transfer these Terms without such consent will be null and void. Gamma Network LLC may freely assign or transfer these Terms, or any rights or obligations hereunder, without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
20. Entire Agreement
These Terms, together with our Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and Gamma Network LLC regarding your use of our services and supersede all prior or contemporaneous agreements, representations, warranties, and understandings (whether oral or written) relating to the subject matter hereof. No modification, amendment, or waiver of any provision of these Terms will be effective unless in writing and signed by both parties, except as otherwise provided herein.
